摘要 摘要 摘要 摘要 3 3 4 4 ABSTRACT Notarization, as a preventive and judicial verification system, is established to guarantee law enforcement, ensure stability of social and economic order, prevent disputes while reducing litigation and also to guarantee the lawful rights and interests for the natural person, legal person and other organizations. Notarized legal documents are superior in evidence application. Not only carries on the probative ability but also obtains the executive force, notarization with enforcement effect plays an important role in maintaining trading order and guaranteeing litigation right of parties. According to the law, notarization has three effects: the evidence effect, enforcement effect and essentials for legal act effect. With a conventionalized title, it is a kind of creditor’s rights documents with enforceable effect assigned by notarial agency. It also indicates a series of behavior, including empowering specific creditor’s rights, helping creditor applying for executive certificate when debtors are inappropriate or refuse to execute the duty and applying to court for enforcement in according with executive certificate. Nowadays notarial system with enforcement effect plays an indelible role in adjusting the social economic life in our country. While due to lack of legal basis and uniform acknowledgement standards in related functional departments, many problems come out when notarial system with enforcement effect are applied in judicial practice.
