I I 摘 要 摘 要 随着信息时代的到来和市场经济的发展，个人信息的经济价值不断凸显，由此衍生 出的个人信息泄露问题正持续且严重地危害着公民的正常生活。我国公民不断加强的个 人信息安全意识与防治个人信息泄露手段的匮乏形成了强烈对比。 本文结合国内外学者的研究成果，采用了实例分析法、理论分析方法、价值分析法、 法律移植方法和比较分析方法，通过界定个人信息领域的相关概念、运用大量实例表述 个人信息泄露的严重现状，得出我国缺乏相应领域的立法规范和相应部门的监督管理， 因此提出预防与治理相结合，要从外部和内部同时构建监督体制，推进《个人信息保护 法》的立法进程，接纳《指南》和《决定》的部分内容、个人信息的范围采取定义加列 举的形式、设立个人信息监管机构、区分个人信息管理者的类别、考虑特殊群体的隐私 范畴、统一立法应当符合我国签订的国际条约和协议的要求、充分借鉴其他国家地区的 立法经验，这也是本文的创新点所在。 关键字 个人信息 泄露 防治 II II Abstract Abstract With the enrolling in information age and the development of market economy, the economic value of personal information appears gradually and results in the reveal of personal information which is doing serious harm to people’s life continuously. It comes into a fierce conflict between people’s enhancing awareness of security of personal information and lack of methods of prevention and governance on the reveal of personal information. By using the methods of case analysis, theory analysis, value analysis, legal transplantation and comparison analysis, with the domestic and foreign researches, the dissertation defines the conceptions in the field of personal information, illustrates the serious status of reveal of personal information, and come to the conclusion that of lacking of legislation and supervision and of putting forward the view focusing on both prevention and governance. Prevention is establishing a supervision system inside and outside, and governance is impelling the personal information legislation. The dissertation puts forward a few of advises that absorb some content of Guide and Decision, define and list personal information range, set up personal information supervision organization, distinguish the types of administrator of personal information, consider the privacy of special crowd, take example by other countries’ legislation experience and legislation should consist with the international treaties and agreements we signed up, which is the innovative part.
