Research on the liability for damages causing by goodwill pick up Abstract time, The person who burden the supplementary liability can ask for the compensation liability form. This situation applys to the infringed by the third party in the goodwill pick up and the uncertainty of the fault caused by the driving man very well . According to the external evidence, driving people belongs to general fault or belongs to slight fault cannot be determined. It can forms the joint tort if identifies the behaviour as the general faults .However, if it doesnt constitute general fault but exists fault. The driving people should bear the supplementary liability .That is to say, when the first order responsibility is a third person who has no ability of compensation, insufficient compensation or his whereabouts is uncertain , the driving man needs to take responsibility and can ask for the compensation liability form for the third people . It should be noted that the total amount of the compensation for the Supplementary liability does not obey to the direct infringer who bear the total sum of damage. It is based on the own behavior which needs to bear the total sum of damage compensation .
