I I 摘 要 在民主国家，议会是汇集并展现国民意志的舞台。为了确保议员能够畅所欲言，真 正担当起人民代表的角色，现代国家无不赋予议员以言论免责权。从理论上而言，基于 人大代表的职业或身份而享有的言论免责权可以认为是公民的思想和良心自由以及言 论自由在代议制中的具体表现。虽然，在当代政党政治中，人大代表或议员的活动要受 到议会党团或所属政党纲领、纪律等的约束，从而在一定程度上削弱了言论免责权的宪 政意义，但这丝毫也不能抹煞其宪法上的价值。 我国人大代表言论免责权是借鉴西方资本主义国家议员言论免责权的基础上发展 而来的。人大代表言论免责权保障了人大机关的自律与独立性，有助于其独立行使宪法 规定的各项职责。为此，借鉴域外法治经验，完善我国人大代表的言论免责权也是一个 重大的理论与现实课题。 本文以“可追诉免除理论”为基点，梳理出人大代表言论免责权的理论基础，探寻 出我国人大代表言论免责权建立的原因以及具体内容，从中分析我国人大代表言论免责 权的现实不足，并在此基础上提出我国应从人大代表言论免责权的行使主体、行使范围、 行使空间、行使时间、行使界限以及人大代表言论免责的法律效果和保障诸方面来完善 人大代表言论免责权制度。 关键词：言论免责权；可追诉免除理论；权利保障 II II Abstract In a democratic country, the Parliament is to bring together and demonstrated the will of the national stage.
