I I 摘 要 摘 要 婚姻家庭是社会的构成基础，一个社会的稳定与和谐必然离不开每个家庭的稳定与 和谐。“婚姻家庭法”是研究有关婚姻家庭的法律制度、法律关系和与此相关的法律现 象的科学。而夫妻财产制度是“婚姻家庭法”立法的重心之一。中国现行的《婚姻法》 中有关夫妻财产制的规定经过几次的修改与补充，已经较为完善，使我国逐渐形成了目 前的夫妻财产制度体系，在保护夫妻双方利益、维护交易安全方面起到了积极作用，但 是《婚姻法》依旧存在规定过于抽象的问题，尤其是夫妻财产与社会经济等相关因素又 紧密相连，随着我国市场经济的繁荣发展，如何健全法律应对随之出现的一些新问题、 新情况，成为我夫妻财产制度建设的重点。 本文通过对夫妻财产制度的历史沿革和现状的研读，从法律渊源和现实特点分析我 国财产制度缺陷，并试图探究我国夫妻财产制度的完善之路。 本文主要分为三个部分：第一部分以夫妻财产制度一般理论出发，进而分析我国夫 妻财产制度的立法沿革；第二部分介绍我国夫妻财产制度立法现状及不足；第三部分从 体系结构及法律内容方面对我国夫妻财产制度提出完善建议。 关键词 夫妻财产制度 基本理论 制度缺陷 立法完善 II II Abstract Abstract Marriage and family form the basis of society, a societys stability and harmony can not be separated each family stability and harmony.
