福建农林大学本科毕业论文 PAGE 第 PAGE 4 页 摘要：交通肇事罪中的逃逸行为所引发的司法认定问题，无论是在学术界，亦或者是在司法实务中，都存在争议。交通肇事罪中的逃逸行为主要有两类，一是交通肇事后的逃逸行为，二是交通肇事后因逃逸致人死亡的行为。本文通过对交通肇事后逃逸行为以及因逃逸致人死亡行为成立条件的分析，对交通肇事罪中逃逸行为的认定以及逃逸行为认定过程中自首、共犯问题进行了探讨。针对交通肇事罪中逃逸行为司法认定中存在的问题，本文提出相应的完善措施。 关键词：交通肇事；逃逸行为；因逃逸致人死亡；司法认定 Abstract：Traffic offences escape behavior in the judicial determination of the issues raised, whether in academia, but also in the judicial practice or are in dispute.
