摘 要 驰名商标是企业的金字招牌，是企业和产品的标识。近年来来，随着市场竞争的不断加剧，商标侵权案件不断发生生，手段和方式不断出新。驰名商标的淡化，就是对驰名商标侵权的一种新的表现形式，这种方式比传统的商标侵权更具有隐蔽性,对企业造成的损失更大。对驰名商标的淡化有关理论、防淡化措施进行研究更具有理论意义和实践价值。全文共分为四部分，第一部分是介绍商标反淡化基本理论；第二部分分介绍反淡化法的保护对象商标有关规定；第三部分，对商标淡化的救济制度进行梳理；第四部分，对我国商标反淡化法律制度进行研究。在借鉴国内外关于反商标淡化有关规定后，就我国商标反淡化法律制度完善进行了思考。本人认为我国在商标制度、反淡化行为制度、淡化救济制度方面还很不完善，也难以适应当前市场经济发展的需要，必须要从立法层面做起，完善相关制度，强化执法和淡化救济。 关键词：商标；驰名商标商誉；商标淡化；反淡化保护 ABSTRACT The well-known trademark is a gilded signboard enterprise is the enterprise and the product identification. In recent years, with the increasing competition in the market, trademark infringement cases continue to occur, means and methods are constantly new. Dilution of well-known trademarks is a new form of expression for the infringement of well-known trademark, which is more subtle than the traditional trademark infringement. It has theoretical significance and practical value to study the relevant theories and measures of anti dilution of the well-known trademarks. This paper is divided into four parts. The first part is introduction of the basic theory of trademark anti dilution; the second part introduces anti dilution method of objects of protection of trademark provisions; the third part and the trademark dilution of the relief system to sort out; the fourth part, on Chinas trademark anti dilution law of research. In reference to the relevant provisions of the anti trademark dilution at home and abroad, we think about the perfect of the legal system of Chinas trademark anti dilution. I think our country in trademark system, anti dilution system and remedy for dilution system is still not perfect, is also difficult to adapt to the needs of the current development of the market economy, we must start from the legislative level, to perfect the related system, strengthen law enforcement and remedy for dilution.
