哈尔滨商业大学硕士学位文 摘要 在当前的市场经济背景下，人们为了满足生活需要、扩大私有财产、获取经 济利益的目的而不断互相交易商品，商品的不断交换使物权变动时刻发生。目前 我国的物权变动制度仍有许多不完善之处，交易市场中存在无权处分、一物多卖 等乱象，不仅损害物权人与买受人的利益，而且严重影响人们的交易积极性、扰 乱市场正常的交易活动。物权变动牵扯到出让人、受让人与第三人各方面的财产 利益，如何平衡物权变动法律关系主体各方的利益，成为我国《民法典·物权编》 需要解决的难题。为保障人们追求效益的积极性、维护社会秩序稳定、促进市场 经济发展，建立公平公正的第三人利益保护体制至关重要。本文通过多种研究方 法，从物权变动与第三人的概念和相关理论入手，分析物权变动中第三人的限定 范围，论证第三人保护的重要性以及保护第三人利益的具体方式与制度，通过考 察域外各国的法律制度，对比分析不同国家法律制度与理论的优劣性，总结归纳 第三人利益保护的可行办法，对第三人利益保护提供完善思路和有力理论。最后 通过分析我国现行法律规定，指出我国相关制度需要改正和完善之处，从而实现 本文研究的最终目标，即保障物权变动中第三人的合法权益。 关键词： 《物权法》；物权变动；第三人 I 哈尔滨商业大学硕士学位文 Abstract In the context of the current market economy, people constantly trade commodities with each other for the purpose of satisfying their living needs, expanding private property and obtaining economic benefits. The constant exchange of commodities makes the real right change happen at every moment. At present, there are stillmany imperfections in thereal right change system in Our country,such as unauthorized disposal and multi-sale in the trading market, which not only damages the interests of the real right holder and buyer, but also seriously affects peoples trading enthusiasm and disturbs the normal trading activities in the market.
