国内社会公共监护制度的构建研究-民法论文-法律论文-法学论文 ——文章均为WORD文档，下载后可直接编辑使用亦可打印—— 　　摘 要：　新时代,随着社会的进步发展和物质生活条件的提高,以及城镇化、无子化和老龄化步伐的加快,亲属担任监护人的可能性日渐式微,无人照料无人监护的特困群体呈几何式增长,政府公共监护资源有限,社会公共监护制度尚不健全。分析构建我国社会公共监护制度的必要性与可行性,提出要引入国际 思想,树立社会公共利益本位观,营造政府承担社会责任氛围,构建以政府公共监护组织为主导、社会公共监护组织为补充的完善的公共监护体系,发挥社会公共监护组织作用,加强政府对社会公共监护组织的监督与管理,构建完善的民政民生兜底保障的社会治理体系。 　　关键词：　特困群体; 社会供养; 公共监护; 治理体系; 　　Abstract：　In the new era, with the development and the progress of the society, the improvement of material living conditions, and the acceleration of urbanization, childlessness and aging, the possibility of relatives acting as guardians is diminishing, and there is a geometric increase in the number of poverty-stricken people without care or supervision. The governments public guardianship resources are limited, and the social public guardianship system is not sound yet. Against such a background, analysis was conducted as to the necessity and feasibility of constructing the social public guardianship system in China. Then proposals were made to introduce the ideology of international human rights, foster a view of taking social public interest as the standard, and create an atmosphere for the government to assume social responsibility; to build a perfect public guardianship system with government public guardianship organizations as the leader and social public guardianship organizations as the supplement. Efforts will be made to give play to the role of public guardianship organizations, strengthen the governments supervision and management of public guardianship organizations and build a sound social governance system for civil affairs and peoples livelihood. 　　Keyword：　poverty-stricken populations; social support; public guardianship system; governance system; 　　当今,随着社会的进步与发展、物质生活条件的提高,以及城镇化、无子化和老龄化步伐的加快,亲属担任监护人的可能性越来越小。目前政府公共监护资源有限,社会公共监护制度尚不健全,特殊困境群体的社会供养难以得到全面落实。为此应明确界定特困群体及监护需求,如农村留守儿童的教育保护需求、身心残障人和失能失智老年人的生活照料需求、孤寡失独老年人的精神抚慰需求等,引入公共监护制度,发挥社会公共监护组织作用,加强政府监督与管理,构建民政民生兜底保障长效机制,实现人们所期待的幼有所育弱有所扶老
