摘要 摘要 伴随着我国改革开放事业的不断推进，医疗卫生现代化水平也在稳步 提高。医疗事业的进步也带來一些问题，医崽关系日趋紧张，医务人员与 患者之间的不信任感逐渐加剧。这其中患者的隐私权不断受到侵犯成为一 个很主要的诱因。但由丁目前我国相关法律法规对于患者隐私权还没有一 个具体的、明确的界定，理论界对这个问题也是众说纷纭，从而导致在具 体实践中对于患者隐私权缺乏行之有效的协调机制，对其保护更是捉襟见 肘、力不从心。因此，我们有必要对患者隐私权的保护从理论和实践上加 以解析，找出一条适合我国国情的保护机制。本文将从患者隐私权相关概 念的界定入手，总结分析实践中侵犯患者隐私权的一些主要情形，进一步 围绕着协调患者隐私权与其他一些权利的冲突展开讨论，对国内外患者隐 私权保护的现状进行分析，找出存在的问题，最后给出笔者认为可行的解 决问题的措施。木文大致分为以下几个部分：第一部分，主要是通过列举 目前国内外学界对患者隐私权给出的各种定义，分析归纳出笔者的观点， 并阐述患者隐私权保护的特征。第二部分，总结出一些比较常见侵犯患者 隐私权的表现并简要分析形成原因。第三部分通过对我国患者隐私权保护 的现状进行分析，并从法律层面找出问题与不足。最后一个部分是针对我 国目前患者隐私权的法律保护的问题与不足，提出一些有针对性的解决问 题的措施与办法 关键词：隐私权，医疗机构，保护模式，权利平衡 ABSTRACT With the enforcement of Chinas reform and opening-up policy, the standard of the medical service has steadily improved? Medical progress has also brought some problems, such as the increasing tension between doctors and patients, increasing trust crisis between medical staff and patients, of which the invasion of patients9 privacy is a major cause. But at present there is no specific, clearly defined laws or regulations for the protection of the patients? privacy, resulting in the lack of effective measures to protect the patients5 privacy in practice? Therefore, it is necessary for us to analyze the ways of protecting the patients5 privacy both theoretically and practically so as to find the most appropriate protection programs. This paper will define the related concepts for the privacy of patients, cite some typical case of the violation of patients, privacy, further around the conflict coordination of patients* right of privacy and other rights are discussed, the status of domestic and international protection of patient privacy analysis, find out the existing problems, finally I think feasible the measures to solve the problem.
