摘 要 地方立法在我国法治建设过程中占主要地位，其为地方的经济、文化和社会发展提供了一定的法制保障。随着社会法治化建设进程的加快以及法治建设的要求，地方在其立法时所体现的自主性立法的重要性越来越突出，自主性立法逐渐成为地方立法的主要形态。但由于不同地方在立法时的人才、技术等方面有较大差异，因此在进行自主性立法时便会出现与上位法相抵触、实际操作性不强等问题。本文通过了解地方立法中的自主性立法的相关理论，并浅析我国一些地区在地方立法时如何发挥其自主性、在自主性立法时存在哪些问题及其解决方法等方面，从而对完善我国地方立法中的自主性立法提出一些建议。 关键词: 地方立法 自主性立法 立法缺陷 对策 ABSTRACT The local legislative power occupies a major position in the process of the governed by law construction in The Peoples Republic of China, which provides a certain legal guarantee for the local economic, cultural and social development.
