延长退休年龄的法律思考 内 容 摘 要 关于退休年龄延长的问题，国内外学者都进行了非常多的研究，但是碍于 会实际的发展现状，经济等问题多变，导致不同的学者或者学派产生不同的意见 和看法，但是无论如何，这是一个迫切需要解决的现实问题。本文在综合分析考 虑了我国国内基本法律规定和外国相关研究情况以后，提出相对具体的建议，首 先从延长退休年龄可以缓解社会抚养压力和增加社会劳动力等方面论述了其必 要性，然后再针对我国目前有关退休年龄的法律条文，阐述了延长退休年龄的可 行性，最后在认为其是必要的和可行的条件之下，综合并且具体地提出了相应的 意见和办法，如制定相关的单行法和设置科学退休年龄等。文中大多采用数据分 析来进行证明和阐述，将当下社会中相应的数据资料进行量化对比分析，通过数 据分析结果，直观展现了所需要得出的结论，同时也利用了相关的数学分析软件 SPSS，来对结果的相关性等做验证，力求结论贴合实际。 关键词：单行法；人均养老保险支出；男女趋同；渐进性 I Legal Consideration on Extending the Retirement Age Abstract On the issue of the extension of the retirement age, scholars at home and abroad have done a lot of research, but due to the current situation of social development and economic changes, different scholars or schools have different opinions and views, but in any case, this is a real problem that urgently needs to be addressed.
