PAGE PAGE 16 劳动争议处理体制问题思考 摘要：劳动争议处理体制是处理劳动纠纷的程序，近些年，伴随全球化的进程，我国的市场经济环境下，劳动纠纷数量激增，现在的劳动争议处理体制在制度设计上滞后。要公正有效率的解决大量存在的劳动争议案件，促进和谐社会发展，需要重构劳动争议体制。本文思考劳动争议预防机制、劳动争议一裁终裁仲裁机制、仲裁前置、裁审关系、三方机制、劳动监察等劳动争议处理体制存在的问题，从保护职工劳动权益尊重当事人意志的角度出发，希望能建立起引导当事人快速合理的劳动争议解决途径，减轻劳动争议司法案件数量多的压力，引导劳动争议通过劳动调解和仲裁结案。 关键词：劳动争议处理体制；劳动争议预防机制；劳动争议一裁终裁 Thought of the issue of labor dispute processing system Abstract: Labor dispute processing system is a procedure of handling labor disputes, in recent years, along with the process of globalization and Chinas market economy environment, Labour disputes have proliferated, present labor dispute processing system lags on the system design.To fair and efficient to solve a large number of labor dispute cases, promote the development of the harmonious society, the need to reconstruct system of labor dispute.This article think a preventive mechanism of labor dispute, labor dispute cutting final arbitration mechanism, the relationship between the cutting trial, the tripartite mechanism, the labor inspection, etc. The problems existing in the labor dispute processing system, from the perspective of protecting worker labor rights and respect the will of the parties, hopes to set up to guide the reasonable labor dispute solution quickly, reduce the pressure of a labor dispute judicial cases number, guide the labor dispute case through mediation and arbitration of labor. Keywords: Labor dispute processing system;A preventive mechanism of labor disputes;A final cutting system of labor dispute 全球化的背景之下，伴随着我国市场经济的全面深化改革，我国的劳动纠纷的数量也呈现大幅度的增长。我国的劳动争议解决机制面临新局势需要作出新的变革。 一、劳动争议预防机制 由于市场经济条件下，劳动力供大过于求劳动者相对处于弱势，劳资矛盾这一根本性的问题无法消除，而劳资双方的法律意识底下，企业缺乏自我消化劳动争议的能力，而我国目前的“一调一裁二审”制度在于调解程序的弱化，仲裁水平不足以及司法机关力量的不足等原因，劳动争议案件的数量近些年来呈现爆发式的增长。为了能最大程度的解决劳动纠纷，缓和社会矛盾，有必要加强劳动争议预防机制。 关于劳动争议预防机制，突出“预防”为主，在萌芽阶段就将火苗熄灭而预防大火。将矛盾及时化解将有利于劳资双方尽快恢复正常的生产生活，促进劳动关系和谐。公平、公正、民主的解决劳动争议有赖于社会各方的协调配合，其中三方机制需要凸显其作用，中国工会需要积极应对变革的世界经济形势，从自身改革，真正起到保护职工利益的作用；而用人单位需要重视劳动者的合法利益；劳动者需要了解普及更多的劳动法知识；公力机构和社会也要为其提供各种相应的助力。劳动争议案件
