摘 要 近年来，境外犯罪数量不断增加，湄公河惨案、江歌案、章莹颖案的发生，使得如何在行 使管辖权中幸免与其他国家发生冲突是我国处理境外犯罪的关键。日本、法国等国家采取的 是有限制属人管辖，但韩国等国家认为应采取无限属人管辖。基于以上情况，笔者将采纳文献 分析法和案例分析法对境外犯罪中国行使管辖权的相关问题进行探讨。本文先从当前我国对 境外犯罪行使管辖权的现状入手，通过举例分析发觉在行使管辖权中存在的问题，再通过对 域外典型国家对境外犯罪管辖的探究，从而提出我国对境外犯罪行使管辖权的完善建议。明 确境外犯罪的管辖权，既维护了我国公民的生命财产权，体现了我国对于人权保障的重视，又 表明白我国 维护世界和平，促进国 和平与进展的发挥了积极作用。与其他国家相比中国 的人口基数大，参加国 交流也较为频繁，在境外犯罪中受到的损害也是最大的。当前我国应 该把形成中国特色的管辖权制度作为处理境外犯罪的首要目标。 关键词 ：境外犯罪；中国特色；管辖权 Abstract In recent years, the number of crimes abroad has been increasing. The occurrence of the Mekong River tragedy, the case of JiangGe and the case of Zhang Yingying makes it the key to deal with the crime in China to avoid conflicts with other countries during the exercise of jurisdiction.Japan, France and other countries adopt limited personal jurisdiction, but Korea and other countries think that unlimited personal jurisdiction should be adopted.Based on the above situation, the author will use literature analysis and case analysis to discuss issues related to the exercise of jurisdiction of overseas crimes in China.This paper begins with the current situation of Chinas jurisdiction over overseas crimes, finds out the problems existing in the exercise of jurisdiction through an example, and then probes into the extraterritorial criminal jurisdiction of typical foreign countries. Therefore, some suggestions on how to exercise jurisdiction over crimes committed abroad are put forward.Clear jurisdiction over crimes committed abroad not only protects the life and property rights of Chinese citizens, but also shows that our country has played an active role in safeguarding world peace and promoting international peace and development.Compared with other countries, China has a large population base, participates in international exchanges more frequently, and suffers the most harm in overseas crimes.At present, our country should take the jurisdiction system with Chi
