中国特色刑事司法鉴定制度完善论——以专家证据制度的引进与融合为视角的中期报告 摘要 2016年，《中华人民共和国司法鉴定法》（以下简称“司法鉴定法”）正式实施，标志着我国司法鉴定制度进一步走向现代化。然而，由于历史和文化等因素的影响，我国司法鉴定制度在实践中仍存在一些问题，如鉴定机构专业性不足、质量不一、审批流程复杂等。本论文旨在探讨我国特色刑事司法鉴定制度的完善问题，以专家证据制度的引进与融合为视角，提出相应的完善建议。 首先，本论文分析了我国现行司法鉴定制度的主要问题，包括鉴定机构的组织形式、专业能力、鉴定质量及鉴定过程中的程序合法性等方面。其次，本文介绍了专家证据制度的基本概念、特点及在国外的应用情况。进而，探讨了我国引进与融合专家证据制度的必要性和可行性，并提出了完善我国刑事司法鉴定制度的建议，如加强鉴定机构的专业性培训，提高鉴定质量和效率，简化审批流程等。 最后，本论文结合实际案例，论证了引进与融合专家证据制度的重要性和实际效果，并指出了其可能面临的挑战和应对策略。 关键词：司法鉴定制度；专家证据制度；完善建议；挑战与应对 Abstract In 2016, the Criminal Procedure Law of the Peoples Republic of China was amended to improve the judicial system of China. However, due to historical and cultural factors, the judicial appraisal system in China still has some problems in practice, such as lack of expertise in appraisal institutions, uneven quality, and complicated approval process. This paper aims to explore the improvement of Chinas distinctive criminal justice appraisal system, taking the introduction and integration of the expert evidence system as the perspective, and propose corresponding improvement suggestions. Firstly, this paper analyzes the main problems of Chinas current judicial appraisal system, including the organizational form of appraisal institutions, professional capacity, appraisal quality, and the legality of the appraisal process. Secondly, this paper introduces the basic concepts, features and applications of expert evidence systems abroad. Then, the necessity and feasibility of introducing and integrating the expert evidence system in China are discussed, and suggestions for improving Chinas criminal justice appraisal system are proposed, such as strengthening the professional training of appraisal institutions, improving the quality and efficiency of appraisals, simplifying the approval process, etc. Finally, this paper combines practical cases to demonstrate the importance and practical effects of introducing and integrating the expert evidence system, and points out the challenges it may face and corr
