夫妻共同债务的认定问题探析

摘要

随着社会和经济的快速发展，人民的生活水平不断提高，人们在物质生活和精神方面的追求一直在不断提高。夫妻双方作为婚姻共同体，拥有自己独立的财产，由于工作不同、工资不同，夫妻双方可能会在消费中基于对共同财产的分配、消费产生问题，而且在不断的往来交易中，夫妻在婚姻存续关系里不可避免地与第三人产生债务关系，而在这种关系下，如何认定夫妻共同债务并且保护各方当事人的利益受到很多人的关注。本文经过对夫妻共有债务的根本理论进行论述。其次通过我国目前的现状进行分析同时结合夫妻共同债务的国内研究现状与国外立法现状进行分析研究，在此基础上查找我国在解决夫妻共同债务认定案件中存在的困难，并且提出完善建议，保证夫妻双方和当事人的利益。

Abstract

Withtherapiddevelopmentofsocietyandeconomy,peopleslivingstandardshavebeencontinuouslyimproved,andpeoplespursuitofmateriallifeandspirithasbeencontinuouslyimproved.Asamarriagecommunity,husbandandwifehavetheirownindependentproperty.Duetodifferentjobsandwages,husbandandwifemayhaveproblemsbasedonthedistributionandconsumptionofcommonpropertyinconsumption.Moreover,incontinuoustransactions,husbandandwifewillinevitablyhaveadebtrelationshipwithathirdpersoninthemarriagerelationship.Underthisrelationship,Howtoidentifythejointdebtofhusbandandwifeandprotecttheinterestsofallpartieshasattractedmanypeoplesattention.Thispaperdiscussesthebasictheoryofhusbandandwifejointdebt.Secondly,throughtheanalysisofthecurrentsituationinChina,combinedwiththedomesticresearchstatusofhusbandandwifejointdebtandthecurrentsituationofforeignlegislation,onthisbasis,findoutthedifficultiesinsolvingtheidentificationcasesofhusbandandwifejointdebt,andputforwardimprovementsuggestionstoensuretheinterestsofbothhusbandandwifeandtheparties.
