Abstract:Intodayssociety,thelegitimaterightsandinterestsofoutsidersareoftenharmedwithouttheirknowledge,buttheinterestsofoutsidersalsoneedtobeprotectedbylaw,soitismoreimportanttoestablishathirdpartytowithdrawthelawsuit.Ringviewoftheworld,inFrance,MacaoandTaiwanafterthethirdpersonrevocationlawsuitsystemisestablished,in2012alsosetupthesysteminourcountry,butsomescholarsbelievethatthesystemdoesnotneedtosetupandtheestablishmentofthesystemcoulddamagetothemajestyofthelegaldocument,somescholarsbelievethattheestablishmentofthesystemisnotperfect,stilllackofpracticalexperience,intheaspectsofsubjectscope,thereliefwayisnotclear.

Thispaperfirstlyanalyzestheconcept,constitutiveelementsofthethirdpartyrevocationlitigationsystemandexpoundsthedifferencesbetweenthetwocountriesonthetheoryofresjudicare.ThentheauthormainlyanalyzestheproblemsexistingintheestablishmentofthesysteminChinafromtheaspectsofthereliefmode,thescopeofthesubjectandthestartingconditionsofthethirdpartywithdrawingaction.Subsequently,thecharacteristicsofthesystemwerecomparedbetweenFranceandTaiwan.Finally,someSuggestionsareputforwardontheexistingproblemsofthethirdpartyrevocationlitigationsysteminChinafromtheaspectsoftheoverlappingofthetrialorgansandthetrialprocedures.
