数字货币对反洗钱的新挑战及应对建议研究

摘要

数码钱币的诞生给反洗钱领域带来了一种崭新的挑战。按照流通市场主体不同，数码钱币又可包括私有数码钱币、合法数码钱币、稳定币等三类。三者所面临的科技风险和司法风险都可归于当前反洗钱法律法规监督能力欠缺、对数码钱币的司法位置不清、对数码钱币交易权责不明确等。其根源就是数码技术发展对构建在工业年代纸钞体制下的反洗钱架构的巨大撞击。本文通过以机制建立为引导，进一步健全对数字货币主体职责和监督，并在此基础上以知识产权信息交易平台建设为重点，逐步建立以持牌准入为主、行为监督为辅的反洗钱监管制度，逐步形成以“法链”为核心的以链治链反洗钱的技术监管机制，并推动“共票”制度在内的数字货币发展创新路径，达到治理数字货币反洗钱现象。

Abstract

Thebirthofdigitalmoneyhasbroughtanewchallengetothefieldofantimoneylaundering.Accordingtothedifferentsubjectsofthecirculationmarket,digitalcoinscanincludeprivatedigitalcoins,legaldigitalcoinsandstablecoins.Thescientificandtechnologicalrisksandjudicialrisksfacedbythethreecanbeattributedtothelackofsupervisionabilityofcurrentantimoneylaunderinglawsandregulations,unclearjudicialpositionofdigitalmoney,unclearrightsandresponsibilitiesofdigitalmoneytrading,etc.Itsrootisthehugeimpactofthedevelopmentofdigitaltechnologyontheantimoneylaunderingframeworkbuiltunderthepapermoneysystemintheindustrialage.Guidedbytheestablishmentofmechanism,thispaperfurtherimprovestheresponsibilitiesandsupervisionofthemainbodyofdigitalcurrency.Onthisbasis,focusingontheconstructionofintellectualpropertyinformationtradingplatform,thispapergraduallyestablishesanantimoneylaunderingsupervisionsystemdominatedbylicensedaccessandsupplementedbybehaviorsupervision,graduallyformsachaingovernancechainantimoneylaunderingtechnicalsupervisionmechanismwithlegalchainasthecore,andpromotesthedevelopmentandinnovationpathofdigitalcurrency,includingthecommonvotesystem,Tocontrolthephenomenonofdigitalcurrencyantimoneylaundering.
