    A1.Exceptwhenthecontextotherwiserequires,thewordsandexpressionsinthisSub-Contractshall

    havethesamemeaningasthoseintheGeneralandSpecialConditionsofContractincludedinthe

    HighwaysDepartmentTermContracts04/HY/2006and05/HY/2006,andthefollowingwordsand

    expressionsshallhavethemeaningherebyassignedtothem:

    “EMMSSub-Contractor”meansthepartyundertakingthisEMMSSub-Contract.

    “HyD”denotesHighwaysDepartment.

    “MainContracts”meanstheHyDTermContracts04/HY/2006and05/HY/2006.

    “HyDPS”meanstotheParticularSpecificationsfortheMainContracts

    “TheEngineer”meanstherespectiveEngineeroftheHyDTermContract04/HY/2006or

    05/HY/2006.

    “TheContractor”meansChiuHingConstructionandTransportationCo.Ltd.

    “NoticetoCommence”meansthenoticegivenbytheContractoraskingtheEMMSSub-Contractor

    tocommencethisSub-Contract.

    “MMWorks”meanstheManagementandMaintenanceWorksoftheMainContractsincludingthe

    WorksasperHyDPSClause37.03andtheworksresultedfromdefaultnotices,auditsand

    inspectionsbytheEngineerref.HyDPSClauses37.08and37.09,comintsandreportsfrom

    anysourcesreceivedviaHyDandtheCallCumInformationCentreoftheContractor.

    “BQ”denotestheBillofQuantitiesofthisSub-Contract.

    “ACSC”denotestheAdditionalConditionsofthisSub-Contract

    “ASSC”denotestheAdditionalSpecificationsofthisSub-Contract
