患者知情同意权保护制度在医患关系中

的反思与重构*

摘要：患者的知情同意权不能得到充分保障是当前医患关系不和谐的重要原因。当前，我国法律侧重保护患者被动知晓诊疗

信息的权利，但对于患者主动知悉诊疗信息的权利保障欠缺，患者知情同意权保护的法律制度存在缺陷，应当建立以医方履行

法定告知义务为基础、保障患者主动获取信息的双重保护机制对现行知情同意权保护制度重构。该机制通过加强患者知情

同意权中主动知悉权的保护，在确保患者对诊疗信息充分知悉理解的同时也协助医务人员完善告知义务的履行，从而促进医

患之间相互理解和信任，为构建和谐医患关系提供全新理论路径。

Abstract：The

inadequate

protection

of

patients

informed

consent

rights

is

an

important

reason

for

the

disharmony

in

doctor-

patient

relationship.

Currently,

Chinese

law

primarily

focuses

on

protecting

patients

passive

right

to

be

informed

about

medical

treatments,

while

lacking

sufficient

protection

for

their

active

right

to

seek

medical

information.

The

existing

legal

framework

for

protecting

informed

consent

is

flawed

and

should

be

reconstructed

by

establishing

a

dual-protection

mechanism.

This

mechanism

should

be

based

on

the

medical

institutions

fulfillment

of

its

statutory

duty

to

inform

while

also

ensuring

patients

proactive

access

to

information.

By

strengthening

the

protection

of

the

active

right

in

the

informed

consent

right

of

patients,

the

mechanism

will

not

only

enhance

their

understanding

of

treatment

information

but

also

assists

medical

staff

in

fulfilling

their

duty

to

inform.

approach

understanding

and

trust

between

and
