人工智能生成内容著作权认定的困境与出路

摘要：【目的目的】随着生成式人工智能技术的迅速普及，其生成内容的著作权认定问题备受争议。

通过分析生成式人工智能著作权认定的相关问题，为解决这一内容在司法实践中的争议提供参考

路径。【方法方法】通过案例分析法和规范分析法，探究人工智能生成内容的本质属性。【结果结果】完善人工

智能生成内容著作权认定的规则体系，应当综合运用解释论和立法论，既要尊重既有的著作权规

则，又要契合鼓励创作的立法目的和激励投资的产业需求。【结论结论】通过规范解释，填补规则漏洞，

克服传统著作权规则的局限性，解决人工智能生成内容著作权认定相关的版权规则、独创性标准、

权利归属等体系性问题。
