公民环境权在我国的实现 摘 要 环境权是人类对于影响其生存和发展的各种自然物质因素所享有的权利和 所应承担的义务的统一,不仅包括公民享有在良好、适宜、健康环境中生活的权 利,而且包括公民享有参与国家环境管理的权利,以及对污染破坏行为进行监督、 检举和控告的权利。但由于法律没有明确环境权的含义,以至在司法实践中难以 操作;环境权出于环境利益和经济利益间平衡的考虑因而有一定限度,但缺乏公 正的利益衡量尺度;环境权的对象具有公共物品性等特征,侵害环境权的行为又 往往表现为间接性,使得环境权的保护和救济不同于传统的权利实现方式,面临 诸多困难。针对环境权的实现所亟待解决的上述问题,建议建立和完善公民诉讼 制度、环境纠纷行政处理制度、公众参与制度以及建立环境损害行政补偿制度, 以期建立健全公民环境权的实现机制。 关键词：环境，环境权，实现 I 公民环境权在我国的实现 Abstract Environmental right is the integration of the right and the obligation of human to all kinds of natural things which affect humans living and development. Environmental right not only includes the right of citizens to live in comfortable and healthy environment, but also the rights to participate in state environmental right has not yet been illustrated in low, so it is difficult to operate it in judicature. Moreover, environmental right has a certain limit because environmental interest and economic interest should balanced, but there is no just standard to weigh those two kinds of interest. The object of environmental right has many special characteristics partly because environment is public goods, and environment tort is often indirect, and for this reason, the ways to realize environmental right are different from traditional methods. To deal with the above questions, this paper makes suggestions to set up and perfect the regimes of group suit, administrative settlement of environmental disputes, public participation, and administrative reparations for environmental damage, in order to build
