集体土地所有权缺陷之原因及发展路径探析.pdfVIP

OO 六年十月 要 集体土地所有权作为我国社会主义国家特有的一种所有权类型，多年来在学 界有着诸多的争论。本文首先从集体土地所有权的概念分析着手，认为应采用具 体列举主义与抽象主义相结合的方式对集体土地所有权进行定义，但因传统民法 中没有集体土地所有权的概念，我国集体土地所有权是法律作为上层建筑机械适 应经济基础的产物，是中国的创造，是具有中国特色的概念，所以不管采用什么 样的定义都无法科学清晰地界定“集体土地所有权”；接着笔者简述了集体土地所有 权产生的过程，对集体土地所有权的现状做一综述，明确了集体土地所有权问题 客观存在多年却仍是难以破题的改革；随后，文章分析了集体土地所有权缺陷背 后深刻的历史、传统、制度等方面的原因，这些原因的分析有助于我们找到今后 集体土地所有权发展模式的合适路径；最后，本文提出了集体土地所有权未来发 展路径，即要树立多元改革的理念。具体而言，集体土地所有权改革的基本取向 是市场化，股份制是 改造的基本方向，而农地的个人所有，在某些区域不应该 成为禁区，同时其他配套改革继续推进、相互配合。 关键词：所有权 集体土地所有权 市场化 1 Abstract The rural collective land ownership as a unique proprietary right in our socialism country has encountered many arguments in the field of law today. First，the author analyzed the concept of the collective land ownership, holding the opinion that we should give a definition to the collective land ownership by concretely enumerate doctrine and abstractly generalize doctrine combine together. But, we all can t give a scientific and clear definition to the collective land ownership, whatever we adopt any kind of definition, because there was no conception of the collective land ownership in the traditional civil law. Our collective land ownership is an outcome that our laws mechanically adapt economic foundation as the superstructure. And it is a Chinese creation with the Chinese special features. Second, the author briefly narrated the process of producing of the collective land ownership and summarized the present situation of the collective land ownership, making clear the fact that the collective land ownership was objectively existing several years but it is still hard break the reform.
