试论宗教财产的属性问题--从江礼开诉付带凤离婚案引起的法律思考.pdfVIP

摘 要 随着我国宗教事业的发展，涉及宗教财产的纠纷不断增多，主要是宗教财产 的属性问题与如何处理纠纷中的宗教财产。如本文所引用的案例中，反映的是夫 妻财产投入宗教场所建设后，该宗教财产能否分割以及如何分割的问题。本文采 取实证研究的方法，通过法律文献、指导老师、报刊网络资料获取理论及信息， 进行对比 析，对我国宗教财产的涵义、宗教财产的来源、宗教财产的属性进行 了分析研究，指出了关于宗教财产的现行法律和政策缺陷明显，对如何构建我国 的宗教立法体系提出了自己的建议，也对具体的宗教财产纠纷提出了自己的见解。 笔者认为，应当在我国宗教立法现状基础上，结合我国宗教事业发展的情况和特 点，借鉴和参考国外相关立法，制定一部统一的 《宗教法》，设定宗教法人制度， 引入宗教社团法人和宗教财团法人概念，统一界定宗教财产的属性，才是解决我 国宗教财产纠纷的根本之路，也是依法治国的必然要求。 关键词：宗教 宗教财产 所有权 1 Abstract With the development of religious undertaking in our country , more and more disputes over religious property have increased . Such disputes mainly fall on the characteristic of religious property and how to deal with it properly . Just as in the case in my thesis , I have raised the question whether religious property can be partitioned and how to partition it after a couple invest their money on building religious arenas . In my thesis , according to these disputes , I use the demonstrated ways to find out the problems in the current laws and I have gained practical theories and useful concerned information by referring to the relevant laws , the instructers , the materials from magazines , newspapers and the Internet . Besides , I compare and analyze them , doing some practical research on the definition of religious property , origin and its characteristic and then point out the deficiany of current laws and policies . Based on all the above , I come up with suggestions on how to build the legal system in our country , refer to relevant laws in some foreign countries and set up a unified Law of Religion ” and Religious Juridical person System ” . At the same time , we should introduce the concept of Religious Juridical person Community ” and Religious Financial Group ” , defining the characteristic of religious property .Th
