Abstract As a result of long-term impact of history and culture, our country has been influenced by traditional Confucian thought “Respect Teaching Profession” for a long time. The society are often over-praised the leading role of teachers. Even though such thinking has always been regarded as the traditional virtues of the Chinese nation, and the ideological basis of shaping “Etiquette Country”, but since China is a country which lay more attention on authority rather than rights, the authority of teachers in the education process is unlimitedly expanded during the teaching process. Thus the dominant position of students has been ignored during the student management for a long time, violating the rights of students can be seen everywhere. In addition, because the concept of privacy is the lack of understanding, in schools, it is considered to be reasonable that teachers read students’ letters, schools announce the achievement of students, and it is lake of legal norms and the implementation system. If we say that the lack of the consciousness of rights is helpless, the lack of the legal protection system is a kind of regret. The concept of Privacy originated from the United States, in which human rights is a foundation of establishing the country. The USA has formed a complete system of legal system of the protection of privacy rights. The U.S. Family Educational Rights and Privacy Act (FERPA) is the basic framework of protecting the students’ privacy rights, and supplemented by the privacy protection provisions of other areas.
