摘 要 【中文摘要】 GATT1994 中的第18条A 、C节是对发展中国家的本国幼稚产业进行保护的“幼稚产业保护条款”。 该条赋予了发展中国家可采用修改或撤销减让和实施进口限制以保护幼稚产业的权利。该条款的缔定完 全符合WTO 的发展的目的。 文章的第一部分介绍了幼稚产业保护条款的沿革及其理念；第二部分分析幼稚产业保护条款的援引 的实质条件和程序条件并附之以案例进行说明；第三部分把幼稚产业保护条款与其他的保障条款进行对 比分析异同，虽在实践中并没是很多国家对该条加以援引，但与WTO 其他保障条款相比，它仍有其不 可替代之处；最后一部分是阐述在激烈的市场竞争中作为GATT 的缔约方之一的中国也有保护本国幼稚 产业的必要，并且完全符合援引该条对本国幼稚产业进行保护的条件，再结合中国国情分析该条款中国 援引的可行性。 【关键词】 GATT 幼稚产业保护条款 中国 关税 数量限制 I 【Abstract 】: Article XVIII .A and C of GATT1994 facilitates the establement of industries by authorizing relevant trade measures for developing countries, named ‘the provision of infant industries protection ’ .This Article supports the infant industries promotion policy, which uses tariff protection and quantitative restrictions to promote domestic industries in the early stages of development. This Article conforms to the development of WTO. In the first chapter, the author gives a brief and overall introduction of the background and principles of the Article; In the second chapter, the author introduces the procedures, when someone want to uses this Article to protect their infant industries, by the cases. In the third chapter, the author essentially analyzes the differences between this Article and other safeguard provisions. It is few countries that use this Article, but we are not doubt that if it is substituted by other articles under GATT. In the last chapter, the author narrates every country has to protect their domestic industries in the fierce whirlpool of the trade’s competition, including China which is one of contracting parties in WTO.
