南京航空航天大学硕士学位论文 摘　　　　要　 我国正处于传统的农业社会向工业社会，计划经济体制向市场经济体制的 转型期。随着混合经济的发展，市场化的劳动关系基本形成并逐渐占据了主导 地位。在已经市场化的领域里，存在大量的违反劳动法律和侵犯工人基本权益 的企业，劳动者受侵害的现象比较严重。对作为职工合法权益的代表者和维护 者，劳动者群体代言人的工会及其维护职能进行考察，显然也具有现实意义。　　 本课题首先从工会的职能入手，回顾了我国工会组织在计划经济体制向市 场经济体制转型中工会模式的转变历程，即由“生产和维护”的传统二元主义 职能模式向“突出维护”的新功能模式；阐述当前工会发挥维权不力的现状； 分析了影响工会发挥维护职能的因素，即制约工会维护职能发挥的制度性因素， 工会组织自身存在不利于维权的因素，及现有维护劳动者权益的相关法律的不 健全等；最后提出了强化工会维护职能的对策，即协调工会与党、政的关系， 加强工会自身的改革与建设，完善立法，为工会发挥维护职能构建法制保障， 包括《工会法》、《劳动法》等保护劳动者权益的相关法律的修改和完善，及劳 动执法的加强等。　 关键词：工会，职能模式，计划经济体制，市场经济体制，维护职能　 i 论工会组织的维护职能 Abstract Our country is in the transformation period from traditional agricultural society to industrial one and from planned economic system to market economic system. And with the development of mixed economy, market-oriented labor relation has come into being. In its field, there are a lot of factories which violated the labor law and labors basic rights and interests, and the situation is serious. As the representative, guardian and the spokesman of labors, trade union and its guardian functio n should be studied, which is very meaningful to the reality. This paper begins from the function of trade union, looking back to the mode of trade union from the planned economic period to market economic period. That is from the traditional mode of production and guard to the new mode of guard stressed. And elaborates the current situation in which the trade union gives play to the function of guard; analyzing the elements that affected the elaboration of its function, including some systematic reasons, some unfavorable factors lying in itself, the imperfect related labor laws which protect labors and so on; finally giving some suggestions that strengthen the function of trade union, that is harmonizing the relations among trade union and government and party, reforming and perfecting the trade union, making the legislative guarantee for unions function, which includes the modification and perfection of related laws which protect labors and the e
