中文摘要 对土地进行立体的利用已成为当今世界的普遍趋势 许多国家于民法典 或  经由制定特别法  或通过司法判例等确立了利用土地地表上下空间的法律制度 在我国 虽然利用空间的现象已非常普遍 但相关的立法相对滞后 学术理论研 究也才刚刚开始 有鉴于此 本文根据国外立法 学说及判例 对利用空间的权 利的产生 行使等若干法律问题进行研究 以期能为立法及法律事务方面提供一 些参考 本文分为以下几个部分进行论述 第一部分是空间地上权概述 空间地上权指的是利用他人土地上下一定范围 的空间建造工作物的权利 空间地上权的确立对一个国家的法学理论的完善和社 会经济的发展都具有重要意义 第二部分是空间地上权的基础理论 本文认为 空间地上权的性质是产生于 土地所有权的一种特殊地上权 空间地上权的设立并不会与一物一权原则发生矛 盾 空间地上权的设立也符合公示原则 空间地上权的确立体现了法律鼓励对资 源的有效利用 节约了交易成本  第三部分是空间地上权本体论 空间地上权的设立只要无碍一般地上权的行 使就不需要经一般地上权人的同意 就空间地上权的效力而言 空间地上权人享 有空间的使用收益权 空间地上权的处分权同时有支付地租 不妨碍先设立的土 地收益权行使的义务 第四部分是我国空间地上权的立法建议 本文认为 我国的空间地上权立法 还停留在初级阶段 立法层次低 立法规范缺乏统一的体系 我国的立法应以空 间地上权为名称 采用以物权法中规定空间地上权为核心 以其他单行民事法律 规范为补充的立法结构 本文还就空间地上权的取得 登记 相邻关系 转让及 消灭效果等基本制度方面提出立法建议  关键词  空间权  地上权  空间地上权  　 　 - Abstract  It becomes a universal tendency to  make use  of land  three-dimensionally in today’s world. A lot of countries, in the ceremony of civil law, or via establishing special law or judicial legal precedent, or through establishing other related laws have established legal system concerned with making use of space of up or under the earth’s surface. In our country, although the phenomenon of making use of space is universal, the concerned legislations are laggard, and the research of academic theory is at the beginning. In view of this, according to the abroad legislation, theory and legal precedent, this paper make a research for the important legal questions such as the generation and the wield of the right of making use of land, with a view to offering some references of legislation and legal practice.
