华中科技大学 硕士学位论文 论我国物业管理制度的完善 姓名：闫翎 申请学位级别：硕士 专业：法律硕士 指导教师：曹茂君 2010-04-29 华 中 科 技 大 学 硕 士 学 位 论 文  摘  要  物业管理起源于 19 世纪 60 年代的英国，随后在世界各地发展起来。上个世纪 80 年代从我国深圳地区传入内地，1981 年我国第一个物业管理公司在深圳成立，但 是对应的统一的《物业管理条例》直到 2003 年才出台，这就使得我国的物业管理在 立法、执法、司法方面都存在大量的空白，并且各地区发展非常不平衡。近年来， 随着房地产业的蓬勃发展，带动物业管理也迅速发展起来，由于法制不健全和我国 居民思想观念的种种原因，出现了大量的物业纠纷且难以有效解决和遏制。所以， 物业管理这种新型的复杂服务型管理亟待于法律的规范和完善。本文从物业管理的 理论概念入手，通过对国外发达物业管理经验的描述以及对我国大陆地区物业管理 现存问题的分析，试图找出完善我国物业管理制度的一些措施，从立法角度、物业 管理当事人角度以及其他方面对我国物业管理制度的完善进行相应的思考和构想。 关键词：物业管理；物业服务；业主自治管理；制度完善 I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract Property Management originated in the 19th century,the United Kingdom 60s,Subsequently developed around the world.It is in the 80s last century imported from the mainland of China Shenzhen.1981,China’s first property management company set up in Shenzhen.But,the corresponding unified“Property Management Regulations”issued  until  2003.This  makes  China’s  property  management  in  the  legislative,law  enforcement,justice,large gaps exist,and the development of various regions is extremely uneven.Recently,with the booming real estate industry,Property Management is moving very quickly.A large number of property management disputes because of the imperfect legal system and the residents the reasons for ideas.The new complex service-oriented management of urgent need in the legal framework and improve.In this paper,the theoretical concept of property management from the start,developed by foreign management experience in the property description and the analysis of China’s mainland property management, attempt to improve China’s property management system to identify some of the measures.From a legislative point of view,property management point of view the parties as well as other aspects of the improvement of China’s property management system carried out thoughts and ideas.
