江苏省失地农民基本生活保障制度设计研究 谭 静① （江苏省国土资源厅） 摘 要：研究目的：针对江苏省现行相关法律对征地补偿安置办法存在单一性和滞后性，以及在 建立失地农民保障制度方面的缺失，提出一种多层次、分对象的补偿安置办法，设计建立普适性的失 地农民基本生活保障制度，并提出立法建议。研究方法：理论分析与实证分析相结合的方法。研究结 果：现行的征地补偿方式不太合理，一定程度上损害了被征地农民的利益，相关法律规范滞后，保障 制度不够完善，亟需建立失地农民生活保障制度。研究结论：多层次、分对象的补偿安置方式，有利 于提高被征地农民的生活水平，加快被征地农民基本生活保障制度建设。 关键词：失地农民；保障制度；立法；江苏 Research on legislation to guaranteeing basic life for landless farmers in Jiangsu Province Abstract: In this paper, taking Jiangsu Province as example, we investigate the current situations of the landless farmers, and the progress of the legislations for living security system. In view of the problems of the policy designed for the current living security system, it’s pointed out that the current system is not fully consistent with the idea of planning the developments of urban and rural area. With theoretical and empirical analysis of the method of combining, the results indicate a new way to establish the living security system which relies on the major role of government, financed by both individual and government. The proposed system is different from the social security system for urban population, but is still consistent with it in some aspects. The frame of legislations for the living security system in Jiangsu Province is also proposed in the paper. It is concluded that: （1） The landless farmers’ basic livelihood guarantee system building in Jiangsu is at the forefront of the country; （2 ） The landless farmers’ basic livelihood guarantee system of Jiangsu has achieved notable results.
