 中国土地开发权转移试验的创新与局限 李家才 （汕头大学公共管理系，广东汕头 515063 ） 摘要：研究目的：分析中国土地开发权转移试验的得失，并提出完善建议。研究方法：对比研究和理论分析。研究结 果：中国土地开发权转移试验经历了“土地置换”和“城乡建设用地增减挂钩”两个阶段；该试验注重利用市场机制， 协调了经济发展与耕地保护的关系，提升了土地管理绩效；该试验的环境保护倾向不突出，开发权交易市场不成熟而 且不够尊重农民权益。研究结论：短期内中国应该改进城乡建设用地增减挂钩，长期内应该推动其向开发权高级形态 转变。 关键词：土地管理；评论；开发权转移；土地置换；城乡建设用地增减挂钩 The Innovations and Flaws of Pilots About Transfer of Development Rights in China LI Jia-cai (Department of Public Administration, Shantou University, Shantou 515063, China) Abstract: The purpose of this study is to analyze the gain and loss of Pilots about transfer of development rights in China, and come up with suggestions for its improvement. Such methods as comparison study and theoretical analysis are employed. The results of this study are as follows: The pilots about transfer of development rights in China develop in two stages: land replacement and link between increase and decrease of constructive land in town and village; such pilots paid attention to utilizing market mechanism, harmonize economic development with cultivated land preservation, improve land management performance while ignoring environmental protection, development rights market building and farmers’ interests. The conclusion of this study is that, China should push forward link between increase and decrease of constructive land in town and village to an advanced form of transfer of development rights in the long run, while improve it in the short run.
