摘要 摘要 行政备案是目前我国行政管理实践中广泛使用的一种管理方式，不过现有的 研究多集中于我国的立法备案制度，而对行政备案的研究尚没有得到足够重视， 研究成果也并不丰富。并且现有的研究大都不够深入，对于行政备案制度的现状、 不足以及如何完善等内容的探讨更是少有涉及，甚至在一些问题上学界还存在着 相反的看法。论文中运用了文献综述，案例分析，实证分析等等方法来对我国的 行政备案制度进行研究。开篇从对行政备案概念的分析入手，梳理法律、行政法 规和规章中有关行政备案的规定，结合行政备案的特征，力求对其概念做出准确 的理解与定义，进而讨论行政备案制度应具有的价值和作用，再结合具体的案例， 分析我国行政备案制度的现状。指出我国行政备案中存在的一些问题，如行政备 案的性质、原则等不明确，适用范围过于宽泛，程序并不规范，审查制度也存在 着缺陷等等，并且找出产生这些问题的原因，经过分析，提出一些对完善我国行 政备案制度的构想。首先，应统一对行政备案概念、性质等的认识；其次提高立 法的科学性，规范行政备案的程序；再次要规范行政备案的审查形式；最后还要 完善行政备案的救济制度。 关键词：行政备案；形式审查；救济制度 Abstract ABSTRACT Administrativerecordisacurrant ofour whichis managementcountry widely usedinadministrative researchfocus existing managementpractice，However,most record onthe of fortherecord．TheresearchoftheAdministration systemlegislation hasnot theresultoftheresearchisnotrich．The gottenenoughattention，and existing researchesare not aswell．Forthe situationofthe mostlydeepenough present to andhowtO administrationrecord discussof unable system，the being perfect in．Eveninsomeacademic are areseldominvolved circles，thereopposite perfect viewsontheissue．Thisarticlewilluseliterature review,case analysis，empirical tO onthe ofadministrationrecord．the andSOon researchsystem be
