物业管理合同的法律问题研究  中文提要  中文提要 随着我国房地产经济的快速发展并逐步成熟，与之配套的现代物业管理模式 初步建立并不断完善，在现代化社区建设和发展中的作用逐步凸显，但仍然处于 起点低、发展慢、保障少、问题多的阶段。物业管理合同引发的纠纷也逐年增多， 呈现出类型多样化、矛盾难以调和等特征，给案件审理带来极大的困难。如何减 少该类纠纷的发生，已成为当前与物业管理相关各方人士及法律工作者们讨论的 热门话题。对于物业管理合同性质、业主委员会的法律地位、前期物业管理合同 以及物业管理合同法律适用等问题，理论界和司法界也一直存在较大的争议。笔 者作为一名法律实务工作者，试图通过理论和实证相结合的方法，从物业管理合 同的概念和性质等法理辨析的基础上，理清物业管理合同的类别及其法律适用， 并对司法实践中的热点难点问题和立法存在的缺陷等问题进行分析，尝试得出物 业管理合同应有名化并对其进行立法完善的必要性的结论。  关键词：物业管理合同  性质  构成  发展趋向  作  者：周瑞星  指导教师：陈立虎 I Abstract  Property Management Legal Research Contract  Property Management Legal Research Contract Abstract With the rapid development of Chinas real estate economy and gradually mature, accompanying the initial establishment of modern property management and continuous improvement, community building and development in the modernization of the role has been showing, it was still from a low, slow development, protection of small and problems of the stage.
