的平衡点，通过这个平衡点来维系警察权在法律控制的范围内正常行使，警察 权能得到充足的、不间断的保障。在警察实务中，警察权的过于宽泛导致警察 权的扩张与警察权益的受限，警察权的制衡机制不够完善导致警察权的滥用和 警察执法权益的受损。笔者认为：首先要从根源上找到问题的症结所在，警察 权规定的过于宽泛致使警察权的无限扩张，所以国家要通过宪法和法律赋予警 察相对具体的警察权，通过法律的手段控制警察权的行使；警察权的扩大意味 着公民权的缩小，警察权的滥用往往使公民权化为乌有，公民权受侵害必然导 致警察权益无法正常实现，所以警察权的保障措施也必然受阻。国家对警察权 的分权制衡可以对警察的执法行为实行实时监督，将不属于警察权范围的职能 分离出去，这样既解决了警力不足问题，又能使警察的职责权限更加专业化， 加强对警察执法的有效监督以防止权力的滥用。加强警察民事法律知识的培训， 提高执法能力。总之，警察权如果在法律控制的范围内行使，以保障人权和自 由为执法的价值目标，那么警察的执法环境将大大改善，最终将促使警察权得 到最大化的保障。 关键词： 警察权法律控制法律保障 U Abstract Police power is a very important national power．The correctness of its power uSiI坞is related to the full realization of civil rights and freedoms，reflected the level of national civilization to a certain degree．In todays society,out of control of the police power results in the abuse of the power and inducement of the con仃oversial issues．Legal control of the police power is currently a hot and difficult subject in the field of the police studies邪well硒a question worthy of careful consideration and discussion．According to academic studies of this area,combined、)l，ith my own working experience，definitions of the police powers nature、necessities of the legal control、forms of abuse of the police power、constructions of its mechanism controlling and the ways of the safeguard of the police power were deeply discussed in this paper．Firstly,perspectives from the topic of the rule of law,I analyze the exercises of the police power in the real life．In the author’S eyes，concerning about human dghts and freedoms become the most important value target of the police power in legal society．The positioning of the nature of police power and the improvement of the system not only provided the practical ability in the controllability of the police power,but had important theoretical and practical significance meaning in rational allocation and legal control of the police power．The out of control of the power will inevitably result in the abuse of police power which hurts the masses’interests．The damage
