I 我国公务员权利救济制度现状分析及其对策研究 摘 要 目前，在我国公务员队伍不断扩大，越来越多的人成为行政机关的工作人 员。因此为了规范和保障公务员的权利和义务，国家需要建立起更加完备的法律 制度体系。作为国家机关的工作人员，其权利直接关系到他们的切身利益以及政 府行政效率的高低。然而在实际的工作中，公务员的合法权益有可能受到不当或 违法行为的侵害，这时公务员必须要寻找有效地途径来保护自己的合法权益。在 我国，公务员的权利救济制度还不是很完善，仅仅限于内部的行政救济，而行政 救济也主要是申诉和控告两种方式。而在司法救济方面更是相当的欠缺，这样就 无法使公务员的合法权利得到有效地救济和保障。本文主要研究的是现阶段我国 公务员权利救济制度的现状及其不足之处，并通过考察西方法治国家公务员权利 救济的模式，从中吸收和借鉴到有效的办法来使我国的公务员权利救济制度更加 完善。另一方面，要加强对我国公务员权利司法救济方面的建设，使其有法可依， 让公务员的权利可以通过法定的程序得到保障。这样才能完善我国的公务员制 度，保障公务员的合法权益，使政府的工作效率得到更大的提高，加强我国法治 社会的建设。 关键词：公务员 权利救济 申诉 控告 司法救济 万方数据 II Analysis and Countermeasures on Current Situation of Chinese relief system for the Civil rights ABSTRACT The civil service continues to expand in China currently, more and more people become the executive staff. Therefore, in order to regulate and protect the rights and obligations of the civil servants, the country needs to establish a more complete legal system. As the staffs of states organs, their rights is related to their own interests and the levels of administrative efficiency directly. However, during the practical work, the legal rights of civil servants may be infringed on by the improper or illegal conducts, so they have to find effective ways to protect their legal rights. In China, the system of rights to relief is not very perfect, it just limited to the internal administrative remedies and it just includes appeals and complaints mainly. And it is considerable lack in the judicial relief, so the legitimate rights of civil service could not be relieved or protected effectively. This paper studies about the current system of civil rights in China and its shortages, according to refer the relief patterns of civil rights in western countries to learn effectives ways to improve our system .
