 我国“官邸制”的立法探讨  中文摘要  我国“官邸制”的立法探讨 中文摘要 “官邸制”是国家为一定级别的在任官员提供住房的一项制度。该制度在我国当 代的提出源自于官员“以权谋房”腐败现象愈演愈烈，亟需制度化规范的需要。本文 探讨了官邸制立法的意义和原则，在综合分析官邸制实施的主客观条件的基础上，确 立了“以立法促改革，地方先行先试” 的官邸制立法径路。以我国古代和现代外国 官邸制的基本情况为导引，结合我国当代的基本国情，确立了官邸制立法的具体内容 和配套措施。本文秉持以法律制约权力的理念，从官邸制的基本功能出发，通过对官 邸制立法的探求，使我国当下官邸制的设计回归官邸制本身，希冀我国官邸制走上一 条符合本土实情和国际趋势的道路。 关键词：官邸；官邸制；立法；权力制约；配套措施  作  者：陈名胜  指导老师：陆永胜 I Abstract  Discuss of Legislation about “Official Residence System” in Our Country  Discuss of Legislation about “Official Residence System” in Our Country Abstract “Official residence system” is the one that a country provides housing for some highly ranking government officials. This system discussed at the contemporary era is because corruption of some officials seeking houses by power is becoming increasingly fierce and needing standard from rules and regulations. This article discusses significance and principle of official residence system legislation, on the basis of analyzing the main and objective conditions, this paper establishes the path “reform by legislation, local governments try first” of official residence system legislation . Guided by introducing our ancient and modern foreign “official residence system”, combining the fundamental realities of our country, the article establishes special content and supporting measures of official residence system legislation. Upholding the idea legal restriction of power and based on the basic functions of “official residence system”, this article focuses on the search of official residence system legislation, appealing that the design of “official residence system” in our country returns “official residence system” itself and hoping the “official residence system” of our country walks on the path of according with local realities and international trend.
