农产品地理标志法律保护问题的研究.pdf

摘要 作为一个农业文明大国，中国有着丰富的农产品地理标志资源， 潜藏着种类众多、优质的农产品地理标志开发与保护的巨大潜力。对 农产品地理标志实施有效的保护，有利于提高地理标志农产品的质量 安全与农产品的声誉，有利于促进我国农村经济的发展和农民的增 收，也有利于提高我国地理标志农产品在国际国内市场上的竞争力， 因此，做好农产品地理标志的保护工作意义重大。然而，目前，我国 关于农产品地理标志的法律保护还处于比较混乱的状态，在法律的制 定和制度的实践上存在有一定的冲突和问题。农产品地理标志作为一 种特殊的工业知识产权，有着自己独特的特征，因此，需要制定专门 的地理标保护法对其加以强有力的保护。况且，采用商标法对农产品 地理标志实施保护存在许多漏洞，它不能给予农产品地理标志全面而 又系统的保护。为了充分发挥我国农产品地理标志所蕴含的巨大的社 会、经济价值，那么关于我国目前农产品地理标志法律保护中所出现 的问题就必须加以解决。 本文从介绍农产品地理标志的概念等基本理论入手，着重阐述了 我国农产品地理标志保护的现状及保护中存在的一些问题，并通过与 国外几个典型国家农产品地理标志保护模式的比较分析，提出我国 农产品地理标志法律保护的完善对策。本人认为，我国应以法国关于 农产品地理标志法律保护模式的成功经验为借鉴，以TRIPS协议为核 心蓝本，建构我国专门的地理标志保护法，加快与国际立法的接轨。 关键词： 农产品地理标志，专门法保护，制度完善 ABSTRACT Our country is a traditional farming civilized great nation． agricultural geographical indication is rich resources．It contains big latent about exploiting and protection．Making an effect protection of agricultural geographical indication is advantageous of advancing the security of quality and reputation of agricultural products： is advantageous of improving the development of economy of the country and accumulating the money of people：is advantage of enhancing the competitive edge in the internal market of the agricultural geographical products．Therefore，it is necessary to protect the agricultural geographical indication．But，at present，our country’S protection of agricultural geographical indication is confusion．There is much disharmony and even confl ict to the market practice．The agricultural geography indication that takes one special industry intellectual property rights，has the unique characteristic，therefore，we need to formulate the special law of geographical indication to perform the powerful protection to it．Moreover，it uses the trademark law to protect the agricultural geography indication that the implementation protection has many defects：it cannot give the agricultural geography indication to be comprehensiVe and system’S protection．To display our country agricultural geography indication ful ly contains huge society，economic valu
