公共利益的概念分析 摘要：公共利益是一个非常重要但又相当模糊的法律概念，公共利益内涵的法律界定正处于理论困惑与实践需求的矛盾之中。国内外对公共利益的理解处于众说纷纭的状态，我国以整体利益为主流，而在国外，到目前为止，都没有哪种学说占据主导地位。公共利益和个人利益、集体利益、国家利益以及社会利益之间关系紧密，通过对它们的比较，可以加深对公共利益的理解。“公共”和“利益”是公共利益的两大要素，通过它们可以分析出公共利益的规定性。 关键词：公共利益 要素 概念 Abstract: Public?interest?is?a?very?important?but?unclear?legal?conception?with confused?definitions.? Both at home and abroad,opinions about the concept of the public interest vary. Chinas mainstream is the theory of collective benefit, and in foreign countries, so far, there is no dominant theory. Through their comparison, deep understanding of public interests can be obtained.Public and interest are two basic elements of the public interests, by analyzing which we can conclude the stipulations of public interests.
