我国业主自治面临的问题及对策研究 学生姓名： 冯伊人 学 号： 2010311365 学 院：政府管理学院 专 业： 行政管理 指导教师： 耿云 论文成绩： 内 容 摘 要 业主自治是一种基层治理模式，即物业管理范围内的所有业主为了满足他们对共同利益的诉求，在建筑区分所有权的基础上，根据法律法规和民主原则确立自治组织和自治规范，并对本区域物业进行管理。在我国，业主自治的发展道路并不畅通，面临着相关法律制度缺失、物业管理建设不健全、业主参与观念淡薄等众多问题。本文旨在通过指出和分析业主自治面临的一些典型问题，探究可行的解决对策。 本文第一部分为文献综述；第二部分从基本概念和特征两个方面介绍了业主自治的基本理论；第三部分对我国业主自治的现状作了一些简要分析；第四部分从法律法规和物业管理制度的缺陷、业主委员会面临的困境和业主参与度等方面入手梳理了我国业主自治面临的主要问题；第五部分根据上述内容进行对策研究，针对业主自治遇到的问题提出了一些可行的应对方法，以便改善社区自治环境，提高业主自治水平。 关键词：业主自治 问题 对策 ABSTRACT Owners autonomy refers to a grass-roots governance mode preserving and promoting the common interests of all the owners. It is based on the building discrimination property rights and is in accordance with laws and regulations. It aims to establish autonomous organizations of all owners of property management in the region. In our country, the development road of owner autonomy is not smooth and is faced with many problems, such as the lack of relevant legal system, the property management and construction’s fail, and ignoring property owners. This article aims to point out and analyze some typical problems faced by owners autonomy, and then explore the feasible countermeasures. The first part of this article is the literature review. The second part introduces the basic theory of the owner autonomy from the two aspects of the basic concepts and characteristics. The third part is some brief analysis on the current situation of the owner autonomy in our country .In the fourth part, I point out some typical problems in owners autonomy which are related to the legal regulations and the defects in the property management system owners facing the committee participation. The fifth part countermeasures according to the above content, the owners of self-government encountered some feasible measures are put forward, so as to improve the community self governance environment and raise the level of owner measures.
