1.0 REASON FOR REPORT
The application was deferred from the 25 July 2006 Committee meeting to enable a site meeting to be held. A copy of the previous report is attached as Appendix 1.
BACKGROUND
The Committee site visit took place on the 1/08/06. During that site visit members asked for a number of points to be clarified. These issues are detailed below.
On- Street parking
The lay-bys opposite the site form part of the highway boundary. Records indicate that they were built at the same time as the former local authority bungalows. However, the lay-bys are for the public parking and are not exclusive to the visitors or occupants of those bungalows.
Control of occupancy
As indicated in the previous report a planning condition to limit occupancy would be extremely difficult to enforce and the most practical way forward in such instances is for occupancy to be controlled by the requirements set out within the Housing Act which are enforced by this Council. The Housing Act specifically sets out space standards and levels of occupancy. Given the size of the proposed dwelling and the proposed internal arrangements, the maximum number of people that could occupy the dwelling under the Housing Act is ten. Any increase in this number could amount to overcrowding and the necessary legal action being taken, though if the internal layout were to change this could allow an increase in the level of occupation.
