摘 要:根据脏手与国家理性学说，公共管理活动对正当目的的诉求常常意味着要采用不正当的手段。但
对目的正当性的片面追求无法避免目的本身被扭曲，从而使得公共管理失去目的与手段的双重正当性，它还
可能导敖公共管理者与被管理者争抢同-道德制高点的伦理困境。现代公共管理必须追求目的与手段的双
重正当性，其理论基础是一种立宪的国家理性，而其实践选择则是行政法治。

Abstraet: Viewed from the perspective of the doctrines of U dirty hands and the re翩。n of state , it follows from the
appeal to the legitimacy of ends in public administration that illegitimate means have to be adopted. The dislortion of
ends themselves will be unavoidable under the single-minded pursuit of legitimacy of ends , so that the duallegiti皿acy
of ends and means will be out of reach in public administration. Meanwhile , it may also lead to an ethical dilemma in
which the public administrators and those administrated scramble for the same moral highland. Modem public admin-
istration must seek for the dual legitimacy of ends and means. The theoretical foundation for lhis is the constitutional
reason of state , and the practical choice is the administration by law.
