成都理工大学文法学院法学系学年论文论离婚过错赔偿制度实施中存在的问题及对策作者姓名：邓钦予 专业学号：法学201109020128指导老师：杨玉华摘要：离婚损害赔偿是指配偶一方因《婚姻法》中规定的法定事项导致婚姻关系的破裂，并给对方造成物质和精神损害时应承担的民事责任。随着社会主义市场经济和社会的发展，人们的维权意识不断增强，如何用法律武器有效、切实地维护自身合法权益成为了社会公众普遍关心的话题。婚姻关系作为一项最基本的民事法律关系，与百姓生活尤为密，更加受到婚姻当事人的重视。《婚姻法》第46条确立了我国离婚损害赔偿制度。当配偶一方违反了夫妻法定义务，实行了婚姻法46条规定的行为，侵害了另一方合法权益并导致婚姻关系破裂时，无过错方有权依据《中华人民共和国婚姻法》中关于离婚损害赔偿的规定来对自己的权利进行救济。本文结合学界关于离婚损害赔偿制度新的研究，对离婚损害赔偿制度实施中存在的问题及完善措施进行分析与探讨，并提出了自己的一些看法和建议。关键词：离婚；离婚损害；请求权；精神赔偿Divorcedamages systemimplementationproblems andcountermeasuresAbstract：Divorceis thelegalmattersdamagesspousebecausemarriageinthe provisions ofthecauserupture ofthe marital relationship, and give each otherthe material and moraldamagecausedshouldbearcivil liability.With the development of the socialist market economy and society, peoples growing awareness of rights, how to effectively use the law as a weapon to effectively safeguard their legitimate rights and interests of the public in general has become a topic of concern. Marriage as a basic civil legal relations, particularly with people living close, more attention by the marriage of the parties. Marriage Law Article 46 establishes a system of divorce damages. When one spouse violates the couples legal obligation to implement the provisions of the behavior of the Marriage Law 46, against the legitimate interests of the other party and lead to marriage breakdown, the innocent party is entitled to based on Marriage Law on the divorce damages provisions to their right to relief.
