论农村集体土地使用权流转机制 重庆工商大学 工程管理 2010级2班 杨枰 2010035238 指导教师 刘加林 摘要：随着人口不断增加和城市建设的发展，加大了对非农建设用地的需求，人地矛盾日益突出。土地作为农业最基本的生产要素，是农民赖以生存的主要生活资料。因此，必须严格规范农村土地使用权流转程序，确保农村土地使用权在流转中增值和维护农民权益。在现有的土地制度框架下，我国广大农村集体土地流转已普遍存在，流转方式多样，但这些流转多是农民一种自发的、无序的行为，存在着流转主体混乱，流转收益分配不合理，农民权益得不到保障等现象。虽然目前我国的《土地管理法》、《农业法》、《担保法》、《农地承包法》等对我国农地使用权流转的规定，极大完善了我国农地流转制度，但仍存在一些不足，因此，如何处理好农地使用权流转问题，实现农村集体土地资源的有效配置，是一个很值得我们深思的问题，对这一问题进行研究与探讨，也是理论与实践的共同要求。 关健词：农村土地使用权 流转机制 农民权益 问题及措施 Abstract: With the increasing population and the development of urban construction, the increased demand for construction land, the people and land have become increasingly prominent. Land as agriculture the basic factors of production, subsistence farmers survival. Therefore, we must strictly regulate rural land use right transfer process, to ensure that rural land use rights in the circulation of value-added and safeguard the rights and interests of farmers. In the existing land system under the framework of Chinas vast rural collective land transfer has widespread circulation ways, but these circulation farmers a spontaneous, disorderly behavior, there is the circulation of the main confusion, circulation revenue allocation unreasonable phenomenon of farmers rights are not protected.
