摘 要 无论是国家在研究发展政策时还是百姓在茶余饭后闲聊时，都会涉及到食品 安全问题。这个历史悠久的问题随着近几年不断涌现出的越发频繁，越发严重的 食品安全问题又再一次成为世界的焦点。食品安全问题其实是一个涉及多类学科 的复杂问题，既包括经济学、社会学、公共管理学又包括化学、生物学等等。本 文主要从行政法学的角度对食品安全的监管模式以及监管主体进行研究探讨，系 统分析我国食品安全监管模式创新的必然性和新型食品安全监管模式的可行性。 本文首先从历史角度纵观我国食品安全的监管历程，分析新中国成立以来食 品安全的发展途径，得出一个事物发展的一般性规律，从而更好的对当代的食品 安全监管体系进行创新研究。本文第二部分主要分析了美国、加拿大、英国这三 个具有代表性的、拥有先进食品安全监管体系的国家的监管模式，并总结出这些 国家食品安全监管模式的共性，以资借鉴。该论文第三部分运用公共管理学理论 以及行政法学理论等知识，研究分析了我国现今食品安全监管模式的缺陷并分析 探讨一套科学优良的食品安全监管模式的应然选择。结合如今市场失灵和政府失 灵时有发生的监管现状，本文第四部分提出建立四位一体食品安全监管模式这种 新型监管模式。该部分首先详细阐述了四位一体食品安全监管模式中的四位参与 主体和四位主体的构建方式，并描述了四位主体在监管体系中所担当的职责和角 色；其次，该部分分析了构建这种食品安全监管模式会遇到的障碍与困难。本论 文的第五部分提出了构建四位一体食品安全监管模式的实现机制。 关键词：食品安全；信息对称；失灵；四位一体食品安全监管模式；第三部门 I Abstract The topic of food safety has been frequently referred by both national development policy and commons conversation. As the food unsafe event happens much more often, people all over the world pays their attentions to the food safety higher than any time before. In fact, food industry is a subject covers economics, sociology, chemistry, biology and etc.. In this thesis, based on the theories of administration, the writer tried to analyses Chinas regulation mode of food safety and give suggestions of building a new regulation mode to help improving food safety. First of all, in order to get the conclusion of how did the regulation mode developed in China, the writer reviewed the history of Chinese regulation mode of food safety.
