出版社 经管分社 现代商务英语 第18章 仲裁 (Arbitration) 对外贸易仲裁是解决对外贸易争议的一种方式。根据我国各进出口公司的实践经验和国际上的习惯做法，买卖双方在发生争议时，可以采取友好协商、仲裁和司法诉讼3种不同的方式来解决。仲裁就是由买卖双方按照在争议之前或争议之后签订仲裁协议，自愿把他们之间的争议交给双方所同意的第三者——商事仲裁机构进行裁决。仲裁的特点在于，由仲裁员作为裁判者对双方的争议事项做出裁决。这种裁决对双方当事人具有约束力。 如果败诉一方不自动执行裁决，胜诉一方有权向法院提出申请，要求予以强制执行，这样就使败诉一方不能无视裁决，逃避责任。但仲裁又不同于司法诉讼，对双方当事人来说，仲裁比司法诉讼具有较大的灵活性，处理问题一般比法院迅速及时，费用也比较低。正是由于仲裁具有这些特点，在国际贸易中，当争议双方通过友好协商不能解决问题时，一般都采用仲裁的办法来解决争议。在对外贸易进出口合同中，一般都订有仲裁条款，仲裁条款的主要内容包括仲裁地点、仲裁机构、仲裁程序和仲裁费用。其中仲裁地点最为重要，因为这同适用哪一国家的法令和规则有密切关系。 18.1 Trade Talks ( G = Gu;?K = Karl ) G: How are you, Mr. Karl?
