摘 要近年来，在世界范围内，金融服务领域中的外包业务发展越来越迅速，特 别是离岸外包形式，更是潮流所趋。在中国，金融服务外包虽是刚刚起步，但是 也已经呈现出了迅猛发展的势头。目前大力承接国际服务外包业务也是我国金融 领域的一个重要发展方向，为此，国家制定了一系列的方针政策来推动国际服务 外包的发展。但是这种新的金融服务形式也带来了新的风险，对开展外包的金融 机构，甚至是金融机构所在国家的金融系统的安全形成了新的威胁。这就要求各 国要采取行之有效的监管措施，对可能的风险加以防范，使金融服务外包，尤其 是离岸外包这种新的金融服务方式更好地为本国的经济发展服务。本文首先简要介绍了金融服务离岸外包的相关概念，特别指出了正确理解这 一概念应当注意的几个问题。文中分析了金融服务离岸外包发展兴盛的原因，以 及外包中存在的风险，并特别分析了在金融危机的大背景下，经济困难对我国以 及国际上其他国家的金融服务离岸外包业务的开展所产生的影响。正是因为金融服务离岸外包存在着诸多的风险，越来越多的国家与国际组织 开始意识到对其进行有效监管的必要性。WTO 作为国际上最具影响力的经济组 织，并没有专门就金融服务离岸外包制定具体的监管规则，但是也有一个原则性 的审慎例外原则供各成员方予以遵守。2005 年巴塞尔委员会组成专门的工作组， 就金融服务外包问题发布了《金融服务外包》文件，其中就金融服务外包的定义、 存在的风险以及监管指引原则等做出规定，以供各国在制定本国的金融服务外包 监管制度时参考示范。美国作为世界上最大的金融服务离岸外包发包国，很早就开始关注对离岸外 包业务的风险防范，制订了一系列的金融监管法律法规，以保证金融服务离岸外 包的安全性。英国也是国际上金融服务外包监管法律制度较为先进的国家 。文 中对这两个国家相关的监管制度进行了介绍，以期对我国金融服务离岸外包监管 制度的构建有所启示。最后，文章介绍了我国金服务离岸外包的发展现状，并总结了我国现有的关 于金融服务外包监管的法律法规。并参考巴塞尔委员会发布的监管指引原则，以及美国与英国关于金融服务外包监管的国内法规定，结合我国的实际，提出我国在构建自己的金融服务离岸外包监管制度时应当注意的问题，并提出了具体的监 管制度立法建议。关键词:金融服务；离岸外包；监管AbstractThe development of outsourcing activity in financial territory getting more and more rapid recently around the world. Current efforts to undertake International service outsourcing business of Chinas financial sector is also an important direction of development. For this purpose the country formulated a series of specific policies to impel the development of international service outsourcing. But this new kind of financial service formhas also brought the new risk.
