中文摘要在社会主义市场经济条件下，现有的集体土地所有权制度暴露出不少现实问题，在某种程度上制约了农村生产力的发展。广东省突破我国的土地管理法律框架，颁发实施了《广东省集体建设用地使用权流转管理办法》，将我国集体土地所有权制度的问题推到了风口浪尖上，改革和完善集体土地所有权制度成为当务之急。本文对集体土地所有权的历史和现状进行了考察，运用法学理论研究方法对学界形成的具有代表性的观点进行了分析，认为我国应当继续坚持和完善集体土地所有权制度。同时，总结出集体土地所有权是集体的单独所有权，农民集体是集体土地所有权的主体。论证要解决集体土地所有权的问题，完善集体土地所有权制度，最根本的是要在平等物权原则下，赋予集体土地所有权与国家土地所有权平等的权能，尤其是使用权能够平等流转。本文通过分析广东省在实践集体建设用地流转过程中取得的成效和出现的问题，提出了对建立建设用地使用权流转制度有益的思路，为最终完善集体土地所有权制度提供了参考。关键词：集体土地所有权农民集体平等物权建设用地流转AbstractInthesocialistmarketeconomycondition,theexistingsystemofcollectivelandownershiphasexposedanumberofpracticalproblems,tosomeextent,restrictedthedevelopmentofruralproductiveforces.GuangdongProvincebrokethroughthelegalframeworkofourlandmanagement,issuedandimplementedthe“theStatuteofTransferManagementoftheCollectiveConstructionLandUtilizationRightinGuangdongProvince”,whichexploredtheproblemofthesystemsofcollectivelandownership.It’strulynecessarytoreformandimprovethesystemofcollectivelandownership.Basedonresearchingonthehistoryandpresentsituationforcollectivelandownership,throughanalyzingtherepresentviewintheacademicfieldforutilizingtheresearchmethodoflegaltheory,thethesisdemonstratesourcountryshouldcontinuetoinsistandimprovethesystem.Atthesametime,summedupthecollectivelandownershipistheindividualownershipofcollective,collectivefarmersisthemainbodyofcollectivelandownership.Toresolvetheproblemofcollectivelandownership,improvethesystemofcollectivelandownership,themostfundamentalistoequalpropertyrightsundertheprincipleofcollectivelandownershipconferredwiththenationaltitletothelandofequalpower,inparticulartherighttotransfertheutilizationright.ThroughanalyzingtheeffectandproblemintheprocessofcollectiveconstructionlandtransferinpracticeinGuangdong,thethesisdemonstratestheusefulideaofestablishingtransfersystemofthecollectiveconstructionlandutilizationright,andprovideareferenceforimprovingthesystemofcollectivelandownershipfinally.Keywords:Collectivelandownership,Farmercollective,Equalpropertyright,Constructionlandtransfer目录引言..............
