民事诉讼中商业秘密保护 　　摘 要：商业秘密作为知识产权的一种，是指不为公众所知悉，属于权利人所独有，具有现实和潜在的商业价值，并且经权利人采取了保密措施的技术信息和经营信息①。是权利人重要的无形财富。在知识经济的今天，商业秘密是企业竞争力的重要支柱，是决定企业成败的关键性因素，对于企业的生存和发展具有重要的意义。商业秘密的发展在推动技术创新和企业财富增长的同时，也推动着整个社会的技术进步。目前我国尚未制定保护商业秘密的专门性法律，只在一些单行的法律、法规中有所规定。但近年来侵犯商业秘密的行为和商业秘密保护的新情况、新问题层出不穷，使得立法状况的缺乏与近年来侵犯商业秘密案件急骤上升，纠纷难以解决的现实状况矛盾。因此，完善对商业秘密的法律保护越来越迫切。文章主要从商业秘密的立法、举证责任、侵权中的保护措施三方面着手，阐述现今的民事诉讼程序对于商业秘密保护存在什么问题以及如何解决问题。以期制定适合我国国情的保护商业秘密的民事诉讼程序。 　　关键词：民事诉讼；商业秘密；举证责任；立法状况 　　T rade secret protection of civil litigation 　　Abstract 　　Trade secret as a kind of intellectual property, is not known to the public, are unique to the right people, with real and potential commercial value, and by the security measures were taken right to the technical information and management information, is the right personimportant intangible asset.In todays knowledge economy, trade secrets, is an important pillar of the competitiveness of enterprises is the key factor deciding the success or failure, survival and development for enterprises of great significance.The development of trade secrets in the promotion of technological innovation and growth of corporate wealth, but also the entire society to promote technological progress.At present, China has not yet developed the special protection of trade secrets laws, only a single line in some laws, and regulations required by law, but in recent years, acts of infringement of trade secrets and trade secret protection of the new situation and new problems emerging, making the status of legislation in recent yearsto abrupt increase in cases of infringement of trade secrets, dispute the reality of the situation difficult to resolve conflicts.Therefore, strengthening the legal protection of trade secrets become increasingly urgent.This paper mainly from trade secret legislation, the burden of proof of the confusion, infringement of the protection measures three aspects, described todays civil procedure exists for the protection of trade secrets, and how to solve any
