AbstractSince1997,Chinasfirstpracticeofthemanagementrighttransferofthetouristattractionhasbeenbeginning,aftermorethantenyearsdevelopment,themanagementrighttransferofthetouristattractionwhichisregardedasaninnovationsystemhasbroughtsignificanteconomic,socialandenvironmentalbenefitsinmanyregionsandpromotedthelocaltouristeconomygreat-leap-forwarddevelopment.Withtheincreaseinpracticeoftransferofthemanagementright,theproblemoftransferpracticeisgraduallyincreasing,soweareoughttoanalyzeandresolvetheseproblemsurgentlyfromdifferentpointofviewanddifferentways.Thisarticleusesthecommissionagenttheory,andexploresthetransferofthemanagementrightofthetouristattractionfromtheperspectiveofthecommissionagentrelationship.Undertheguidanceofagenttheory,thispaperanalyzestheagencybyagreementrelationship,exploresthereasonsthatcausesuchkindofrelationship,researchesthecharacteristicsandstructureofthatrelationshipandconstructsthemodelofthatrelationshipunderasymmetricinformation.Throughtheanalysisoftheagencybyagreementrelationshipofthemanagementrighttransferofthetouristattraction,theproblemsoftheagencybyagreementexistingintheagencybyagreementrelationshiphasbeenclarified,therootoftheproblemshasbeenanalyzedandthesolutionfortheproblemshasbeenproposed.Theagencybyagreementrelationshipafterthemanagementrighttransferofthetouristattractioncontainstwokindsrelationship,oneistherelationshipbetweenthegovernmentandthecitizens,andtheotheristherelationshipbetweenthegovernmentandtourismenterprises.Themaincharacteristicsoftheagencyrelationshipare:theclientidentityforthepublicperformanceisnotclear,thegovernmentisinakeyposition,agencychainislong,andconsignmentriskandagencyriskcoexist.Thecommissionissuesandagencyproblemscoexistintheagencyrelationship.Theagencyproblemsaremainly:theagentsbehaviorislackingsupervision,theagentsshort-termbehavior,rentseekingproblemandinternalcontrolissues;commissionproblemsaremainly:commissionbiasandtaskdiversity,highcostsofcommissionandtheexternalcontrolproblemscausedbyringuponringcomm
