摘要摘要人民检察院是我国宪法和法律明确规定的国家法律监督机关。刑事诉讼中的侦查监督是人民检察院的一项重要工作职能，近年来，检察机关紧紧围绕强化法律监督、维护公平正义工作主题，积极履行法律监督职责，对惩罚犯罪、维护刑事诉讼当事人的合法权利、防止侦查权的滥用起到了不可或缺的重要作用。但是，我们也应该看到，由于检察机关工作人员观念上存在的一些问题以及我国法律对侦查监督的相关规定不尽完善，造成了检察机关的侦查监督存在着监督范围狭窄、监督于段无制度保障、检察机关自侦案件侦查监督空白及侦查监督主体设定的缺陷等种种问题。针对我国检察工作人员在理念上存在的问题及侦查监督制度存在的这些缺陷，本文作者在实际工作基础上，首先在论文第一部分探讨了侦查监督的基本问题，介绍了侦查监督的概念、内容、目的、理论基础及确立检察机关侦查监督制度的意义。本文的第二部分为对国外英美和大陆两大法系的侦查监督制度的考察和评析，通过与我国侦查监督制度的比较，便于我国司法理论及实践吸收借鉴两大法系在侦查监督制度方面的合理因素。本文的第三部分是对我国的侦查监督制度的现状进行分析的基础上，找出我国侦查监督制度在观念上及法律制度上存在的问题。针对我国侦查监督制度存在的问题，本文的第四部分对改革和完善我国的侦查监督制度提出自己的粗浅设想，以期更有利于促进检察机关的侦查监督工作，更好地实现刑事司法的公正价值，更好的促进和谐社会的建立。关键词:侦查监督基本理论制度缺陷AbstractAbstractChinasConstitutionandthelawexplicitlyprovideforthePeoplesProcuratorateisanorganofthecountryslegalsupervision.TnvestigationsupervisionofpenallitigationsisanimportantfunctionofthePeoplesProcuratorate.Tnrecentyears，procuratorialorganfocusontheworkthemeofstrengtheninglegalsupervisionandsafeguardingjustice，andactivelyfulfillstheirlegaldutiesofsupervisiononthepunishmentofcrime，maintaininglegalrightsofpenallitigantandpreventingabuseofthedetectionright，playinganindispensablerole.However，weshouldalsoseethattheprosecutionstaffhavesomeproblemsthattherelevantlegalprovisionsofexistingontheinvestigationsupervisionarenotperfect，resultinginthattheprosecutionsupervisionoftheinvestigationisanarrowrangeofoversight，nosystemofsecuritymonitoringtools，andtheprosecutionTtselfsupervisionofinvestigationanddetectionofgapsinoversightofthemainsetofdefects.Contraposingtheselimitationsofsystemofinvestigationsupervision，thispaperonthebasisofactualwork，thefirsttheoreticallydiscussesthebasicproblemsofinvestigationsupervision，introducestheconcept，content，purposeandtheoreticalbasisofinvestigationsupervision，andestablishsthesignificanceofsystemsofProcuratoratesinvestigationsupervision.ThesecondpartofthispaperisaboutinvestigationandassessmentofthemainlandofBritishandAmericanforeigninvestigationoftwolegalmonitoringsystems，throughthecomparisonofTnvestigationwithChinasmonitoringsystem，eas
